Store PoliciesReturns/CancellationsRETURNS -If you are not satisfied with your purchase, please contact us for a Return Merchandise Authorization (RMA) request within 10 business days of the receipt of the product. If the item is returned unopened in the original box, we will exchange it, offer you store credit, or offer you a refund, less 25% restocking fee, based on your original method of payment. The product must be returned within 10 business days of the issuance of the RMA. All products must be packed in the original packaging, including any accessories, manuals, documentation and registration that shipped with the product. A 15% open box fee in addition to the 25% restocking fee (totaling 40%) will be assessed on any sealed product that is opened or removed from its original packaging. Please note that we do not permit the return of the following products: 1. Special orders and products that are custom configured to your specifications. 2. Products sold "as is" or "used" or that have been installed or used after receipt. 3. Illumination devices, electronic sights, optics and night vision equipment. 4. All sales of firearms, and loaded ammunition are FINAL, and returns, refunds or exchanges are NOT ACCEPTED. Orders shipped to a FFL are FINAL UPON SHIPMENT. Once a firearm is shipped to the FFL, BC Armory LLC will not accept a return or exchange under any circumstances. If a defect is discovered by the customer after shipment, the customer must contact the firearm manufacturer directly for replacement or repair. NOTE: We recommend that you use a carrier that offers shipment tracking for all returns, and either insure your package for safe return or declare the full value of the shipment so that you are protected if the shipment is lost or damaged in transit. If you chose not to use a carrier that offers tracking and insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping. The United States Postal Service (USPS) offers limited tracking capabilities and that there is a 30-calendar-day waiting period before USPS will initiate a trace. The customer is responsible for shipping charges both ways on returns, as well as for shipping charges on shipments that are refused. CANCELLATIONS - Orders placed with BC Armory LLC may be cancelled by the customer prior to the item having shipped. All cancellation requests must be made via email (bcarmory@outlook.com). You MUST provide the order number in the email. All cancellations will be charged a 10% restocking fee. This fee will be based on the total invoice amount. If the item/package has shipped, the order may not be cancelled and the customer must follow all rules applicable to returns. Please note that the return of the item/package will be made at the customer's expense. Cancelled orders may not be reversed. All cancellations are final. BC Armory LLC charges a 20% restocking fee and an amount equal to the original shipping costs for any final orders cancelled via debit or credit card chargeback after shipment to the FFL. By placing an online order with BC Armory LLC, the customer agrees to pay all restocking and shipping fees associated with any order that is cancelled via debit or credit card chargeback following shipment to the FFL. CUSTOMER FURTHER AUTHORIZES AND CONSENTS TO BC ARMORY LLC CHARGING THE AFOREMENTIONED FEES TO THE DEBIT OR CREDIT CARD USED TO PLACE THE ORIGINAL ONLINE ORDER. BC Armory LLC reserves the right to dispute any bank or credit card chargebacks. BC Armory LLC reserves the right to refuse all future orders placed by any customer that cancels an order via debit or credit card chargeback following shipment. All payments are processed immediately upon placement of order. It is the responsibility of the customer to know and be in compliance with all applicable federal, state, and local laws related to selling, transferring, possessing, transporting, or using a firearm, magazine, and ammunition in the locality in which the customer resides. IN STORE PICKUP ORDERS Customers have 30 calendar days to pickup orders. If order/s are not picked up within the 30 calendar days, we reserve the right to cancel the order/s. Cancelled orders will be charged a 10% cancelation fee and a store credit will be issued. All descriptions for used items are honest and based on actual items being offered for sale. Items being sold in this manner will be marked as such. All sales on used items are final. All machine guns are considered used unless otherwise noted.General Firearm SalesAll firearms, magazines, receivers and restricted law enforcement items are sold and shipped in accordance with all existing federal, state and local laws and regulations. Many of the firearms, magazines and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering. You must be 18 or older to purchase a long gun and 21 or older to purchase a handgun per ATF rules, but state and local laws may differ and you will need to check your local laws before purchasing a firearm.All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories and applicable warranty. Firearms requiring warranty work must be returned to the factory within 1 year of purchase for repair. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special order items. Form 4473 & Background Checks – If you do not have a valid Arkansas CHCL license, a background check is required to transfer an item. We require you to pass the background check by receiving a “Proceed” from the FBI NICS system prior to transferring the item. If we do not receive a “Proceed” from the FBI NICS system and the submitted background check expires (30 days after submission) in the FBI NICS system, we can either submit another background check or provide a refund. SHIPPING A FIREARM - FFL'S AND TRANSFER OF OWNERSHIPBC Armory LLC will ONLY transfer ownership of a firearm to individuals or agencies in possession of a valid Federal Firearms License (FFL). This means we cannot ship directly to you unless you are an FFL holder.If you do not hold a valid FFL, BC Armory LLC will transfer your purchased firearm to your choice of a licensed gun dealer in your state. It is your responsibility: 1. To ensure that a firearm is legal to own in your state. 2. To contact the FFL you want the firearm shipped to and have them email us a copy of their Federal Firearms License (FFL) to bcarmory@outlook.com. We MUST receive a copy of the FFL via email DIRECTLY from the FFL. They must reference your name and the order number in the email. This must be sent to bcarmory@outlook.com before we will start processing your order for shipment to the FFL. 3. To complete all required paperwork when you pick up your purchase from your local dealer Be aware that it is customary for your local dealer to charge a transfer fee at the time you pick up your purchase. This transfer fee is strictly between you and your local dealer. Please check with your local dealer concerning their policies. You do not pay BC Armory LLC the transfer fee. The buyer is responsible for contacting their transferring FFL to request they send a copy of their FFL to us. Our contact information is as follows: bcarmory@outlook.com TRANSFER: If your FFL refuses to transfer the item for any reason, you are responsible for all associated fees/expenses including but not limited to packaging, handling, shipping, etc. back to BC Armory LLC. These fees will be removed from the total amount paid prior to issuing a refund. We will not process a refund until item/s are received by BC Armory LLC. ID REQUIREMENTS: If you live in a state that requires a specific Firearm Identification Card to purchase/own a Firearm, we must receive an email with a copy/photo of that card and your drivers license prior to processing your order. Consumer Data PrivacyWe respect your privacy and are committed to protecting it.The Credit Card Billing Information, Shipping Information, and Contact Information in our checkout process are required in order to process your order and deliver the product to you. We store some information for accounting reasons. Your information will not be shown to third parties not involved in the transaction, nor used to send you any unrequested information. The entire Checkout process is handled through a secure SSL-encrypted connection. The Credit Card Billing Information is sent directly to our payment provider who processes your credit card transaction. Ammunition PurchasesYou must be 18 or older to purchase rifle or shotgun ammunition and 21 or older to purchase handgun ammunition. All ammunition will be shipped ground with adult signature required. Always make sure to use the correct ammunition for your specific firearms. Check your local laws for any other regulations. *All ammunition sales will comply with local and state laws and will not be shipped to any restricted areas.* It is your responsibility to know what YOU can and cannot own in your state. The customer assumes all responsibility and cost for returned firearms due to FFL refusal or failure to receive.Shipping Restrictions 1. BC Armory LLC will not sell/ship ANY items to: District of Columbia (Washington D.C.), California, Hawaii, Alaska, Massachusetts, Puerto Rico, and the City of Chicago, IL. 2. BC Armory LLC will not sell/ship ANY AR or AK Parts or Firearms (Including Receivers) to residents of the state of Connecticut, the state of Illinois, the state of New Jersey, the state of Maryland, the state of Massachusetts, or the state of New York. 3. BC Armory LLC will not sell/ship any AR or AK parts to Boulder, Denver, or Vail Colorado. All of the above outlined orders will be cancelled and the customer will be charged a 5% fee. Please note that BC Armory LLC DOES NOT ship high-capacity magazines with firearms to the states listed above. We WILL NOT replace high-capacity magazines with state compliant magazines. We DO NOT offer refunds in place of the magazines. (Magazine Ordering Restrictions) It is the customer’s responsibility for understanding state laws regarding magazine capacities. Customers ordering magazines that are illegal to own in their state will have their orders cancelled and will be charged a 20% restocking fee. California — No Sales. SHIPPINGWhenever possible, we will combine shipping for multiple small accessories on the same order. However, because certain accessories can be drop shipped from various warehouses, the shipping rates may increase. Any accessory shipped from another warehouse will incur an additional $5.00 increase in the base shipping cost.BC Armory LLC is not responsible for items lost or damaged in transit. The shipping and handling charge covers the cost of standard shipping. If you require expedited shipping or insurance, the shipping fees will be greater. ACCESSORY RETURNSReturns are ONLY accepted for merchandise found defective immediately upon receipt. Immediately upon receipt is defined as 24 hours from the time the item is delivered.You must contact BC Armory LLC via email within the 24 hours and request an RMA (Return Merchandise Authorization) before you ship product back to us. DO NOT SHIP THE PRODUCT BACK TO US UNTIL WE PROVIDE YOU WITH AN RMA. We will only provide communication on returns via email. If you do not hear back from us within 2 business days, please call us. Your email might have gone to the Junk/Spam folder. Returns must be received by BC Armory LLC within 10 calendar days of RMA being provided to customer. Accessory items that have been opened from the manufacturer packaging will not be accepted for return. Returns will NOT be accepted for any accessories that have been installed/mounted. Most accessory items have a manufacturer warranty. Please contact the manufacturer if there are any issues with/post installation. Original shipping charges are NOT refunded if the item is NOT found to be defective. Customers will be responsible for return shipping in these cases. Returns may be subject to a 15% restocking fee. TRANSFERSStandard Transfers:We charge a receiving/background check fee of $20.00 for standard non- NFA transfers. All transfers are available for pickup the day AFTER arrival. No exceptions. NFA Transfers: (National Firearms Act Items) All NFA transfers will be charged a fee of $75.00 for any Machine Gun, Suppressor/Silencer, AOW (Any Other Weapon), Destructive Device, and Short Barreled Rifle. 90 Day Layaway Plan90 Day Layaway Plan - THIS IS ONLY FOR LOCAL PURCHASES. THE DEPOSIT AND PAYMENTS MUST BE MADE IN PERSON.No Fees for the First 30 Days $49 Minimum Purchase Required Only New Firearms are eligible for this program. The layaway plan is very simple to use. Upon receipt of your non refundable 20% deposit, we will secure your firearms(s) from our inventory and activate your 90 day Layaway Plan. There are no fees during the first 30 days. A $10 fee will be added to layaway orders that remain open after this initial 30 day period. After 60 days, an additional $15 fee will be applied to your balance. During the Layaway period, you can either make multiple payments, or just make one final payment at the end. Customers are allowed 2 open no fee layaway orders at a time. UNDER NO CIRCUMSTANCES WILL YOUR LAYAWAY BE HELD LONGER THAN 90 DAYS. If, after 90 days, we have not received payment in full, your Layaway Plan will automatically be canceled and any/all payments will NOT be refunded. Items on a layaway cannot be changed once the 20% deposit has been received. If a layaway is cancelled prior to 90 days the 20% deposit will NOT be refunded. Legal DisputesLegal DisputesThese Terms and Conditions shall be governed by the laws of the State of Arkansas. By placing an online order with BC Armory LLC, customer hereby: 1. Submits to the exclusive jurisdiction of the federal or state courts located in Benton County, Arkansas, in any litigation, suit, action or proceeding arising out of, or relating to, the order or these Terms and Conditions 2. Knowingly, voluntarily, and irrevocably consents to the personal jurisdiction and venue of said court 3. Waives any right to dismiss or transfer it may have based on improper venue or forum nonconveniens to the conduct of any proceeding in said court. By placing an order through this website, customer agrees to HOLD HARMLESS AND INDEMNIFY BC Armory LLC for any and all costs, damages, or expenses (including reasonable attorney and other professional fees and disbursements) arising from any claim, cause of action, or legal dispute of any kind arising from or relating to the transaction or BC Armory LLC’s enforcement of these Terms and Conditions. Severability If any provision of these Terms and Conditions shall to any extent be held invalid or unenforceable by a court of competent jurisdiction, then: (a) the remainder of the Terms and Conditions shall not be affected, and every remaining provision of the Terms and Conditions shall be valid and binding to the fullest extent permitted by law, and (b) a suitable and equitable provision shall be substituted for such invalid and unenforceable provision in order to carry out, so far as may be valid and enforceable, the intent and purpose of such invalid or unenforceable provision. |
